DUI Second Offense in Georgia

Because habitual DUI offenders are responsible for a large number of fatal collisions, state lawmakers have passed legislation to punish those individuals who have a prior history of DUI more severely than others. Therefore, if you are convicted of a second DUI, you can expect a jail sentence of 90 days or longer, as well as an 18-month license suspension, and minimum $600 fine.
In addition to these penalties, you will also be required to perform no less than 30 days of community service and, in some cases, the judge may order you to undergo counseling and/or enroll in a driver's education program—all at your own expense. You may even have to get an ignition interlock device installed in your vehicle for up to six months before you are eligible to drive again.
Once you are convicted of a second DUI, the state will also confiscate your license plates and require you to pay to have your name and picture published in a local newspaper to notify the public of your conviction. Plus, your conviction will be permanently reflected on your criminal record, where it can be easily found by anyone who checks your background—including potential employers, housing providers, and educational institutions.
Of course, being arrested for DUI is not the same as being convicted of the offense—and before that can happen, the state must first prove you guilty in a court of law.
